Probate Rules of Practice

Local rules of practice before the Pima County Probate Divisions are set forth in Pima County Local Rule 9. Insofar as the existing local rules are inconsistent with the newly-effective statewide Rules of Probate Procedure, the local rules are superseded by the statewide rules.

The Presiding Judge of the Probate Bench for the Superior Court of Pima County is evaluating and revising the local rules. Pursuant to Administrative Order No. 2009-04, the Presiding Judge shall submit new rules no later than December 1, 2009, for consideration by the Arizona Supreme Court.

The Supreme Court has adopted the Arizona Rules of Probate Procedure, which were effective as of January 1, 2009. The Arizona Rules of Probate Procedure may be viewed at the following link:
