A PROCEDURAL GUIDE TO ROUTINE FILING IN PROBATE, GUARDIANSHIPS, AND CONSERVATORSHIPS

A guardian of a minor has the same powers and responsibilities as a parent, except that a guardian is not legally obligated to contribute to the support of the minor from the guardian's own funds. Proof of guardianship is shown by certified "Letters of Guardianship" which the court issues. Keep your Letters in a safe place and make copies to show schools, doctors, etc., when necessary.

Notice must be given to both parents of the minor, the minor's guardian or conservator, anyone with whom the minor has lived within the past 60 days, and the minor who is 14 or older. A copy of the notice of hearing and the petition must be mailed to these persons at least 19 days before the hearing or hand-delivered at least 14 days before the hearing. In the alternative, these persons may sign a consent to the guardianship and a waiver of the requirement of notice. Any of these persons whose whereabouts are unknown must be noticed by publication after a diligent search. The following documents are required:

  1. Petition for Appointment of Guardian(s) of Minor(s) (Form G/C-5)

  2. General Order to Guardian and Conservator

  3. Letters and Acceptance of Guardianship of Minor(s) (Form G/C-2)

  4. Notice of Hearing (Form G/C-11A)

  5. Proof of Notice (Form G/C 100)

  6. Proposed Appointee's Affidavit Pursuant to A.R.S. 14-5106 (Form G/C-42)

  7. Verified Statement Pursuant to A.R.S. 14-5651 (Form G/C-41)

  8. Affidavit Regarding Minor Children (Form G/C-43)

  9. Information Sheet

  10. Consent and Waiver

  11. Order Appointing Guardian(s) of Minor(s) (Form G/C-13) Consent of Minor & Waiver of Notice if age 14 or more (not necessary if notice is mailed or delivered as set forth above).
