Probate FAQs

When a minor reaches the age of majority, the conservatorship must be terminated. The minor's funds will be released to the minor, the conservator discharged, and the file closed. For procedural guide, refer to: Petition to Terminate Conservatorship and Release Funds

When a Conservator wishes to use a minor's assets which are court-controlled, a petition for withdrawal of funds and a court order is necessary. For procedural guide, refer to: Petition for Withdrawal of Funds from a Minor's Restricted Account

Notice must be given to both parents of the minor, the minor's guardian or conservator, anyone with whom the minor has lived within the past 60 days, and the minor who is 14 or older. A copy of the notice of hearing and the petition must be mailed to these persons at least 19 days before the hearing or hand-delivered at least 14 days before the hearing. In the alternative, these persons may sign a consent to the guardianship and a waiver of the requirement of notice. Any of these persons whose whereabouts are unknown must be noticed by publication after a diligent search. Refer to: Petition for Appointment of Guardian(s) of Minor(s) for additional information.

This form is called Affidavit of Succession to Real Property and is filed with the Clerk's office. There is a fee of $146.00, and, generally, $19.50 for the certified copy of the affidavit that you will need to record. (The certified copy fee is dependent on the number of pages.) This fee is subject to change. Check with the Clerk's office to verify actual fee amounts. The clerk takes cash, Visa, or MasterCard for filing fees. For additional information, refer to: Affidavit of Succession to Real Property ARS 14-3971(E). A certified death certificate and original will (if there is one) must accompany the affidavit.

This form is called Affidavit for Collection of Personal Property and is not filed in Superior Court. It is presented to the person holding the property. If there is personal property (bank accounts, stocks, vehicles) registered in the decedent's name, the property may be collected by presenting the affidavit to the appropriate person, business or agency. Probate can be filed formally by petitioning the court and setting a hearing, or informally by applying to the Registrar.
